Privacy Policy

1. Overview

Nordthane Capital is a trade name used by Nordthane Capital LLC, a Wyoming limited liability company. We arrange business-purpose invoice factoring by introducing businesses to independent funding partners. We are not a lender and we are not a factor. This Privacy Policy explains how we collect, use, disclose, and safeguard information submitted through our website, application forms, email, and related communications.

Because we assist businesses in obtaining financing, we are a "financial institution" for purposes of the federal Gramm-Leach-Bliley Act (GLBA), and this Policy also serves as our privacy notice under that law.

2. Information we collect

Business contact information: your name, role, business email address, telephone number, and the state in which your business operates.

Business information: legal business name, DBA, entity type, state of formation, Employer Identification Number, industry, time in business, MC or DOT number where applicable, and monthly invoice volume.

Receivables documentation: accounts receivable aging reports, customer and debtor lists, invoices, and proof-of-work documents such as rate confirmations, bills of lading, signed timecards, closed work tickets, and statement-of-work sign-offs. Funding partners may later request bank statements or financial statements.

Communications: records of calls, emails, text messages, and other correspondence with us, including notes about your funding request.

Technical information: IP address, browser type, device information, referring URL, and pages visited, collected through cookies and similar technologies. Where you give consent through our forms, we also record the date, time, IP address, and wording of that consent.

We do not request Social Security Numbers, dates of birth, or driver's license numbers through this website. We do not knowingly collect information from anyone under 18, and our services are directed exclusively to businesses and their authorized representatives.

3. How we use your information

We use this information to evaluate your factoring request; prepare and package it for submission to funding partners; identify partners whose criteria may fit your profile; communicate with you about your request; respond to partner questions and document requests during underwriting; maintain records required by law; and, where you have given consent, contact you about factoring services.

4. How we share your information: please read carefully

Nordthane Capital is an intermediary, so our core service requires transmitting your information to third parties. By submitting an application or documents, you authorize us to disclose the information and documentation you provide to:

Independent factoring companies and funding partners; their underwriting and verification teams; and our service providers, including document storage, customer relationship management, communication, and analytics vendors bound by confidentiality obligations.

We transmit this information solely to obtain factoring offers on your behalf, and we may transmit it to more than one funding partner at a time to source competing terms. Once your information reaches a funding partner, that partner handles it under its own privacy policy, over which we have no control. We encourage you to review the privacy policy of any partner whose offer you accept.

We may also disclose information as required by law, subpoena, court order, or regulatory request; to protect our legal rights or defend against claims; in connection with a sale, merger, or transfer of our business; and with your consent for any other purpose.

We do not sell your personal information to marketing firms, data brokers, or list vendors, and we do not share it for cross-context behavioral advertising.

5. Credit reports, UCC searches, and invoice verification

You authorize us and the funding partners we submit your file to, as permitted by law, to obtain business credit reports about your company and about the customers who owe you money, to search public UCC filings and lien records, and to verify invoices and proof-of-work documents directly with your customers. Invoice verification typically involves the funding partner contacting your customer to confirm the work was completed and the invoice is approved for payment.

6. Telephone calls and text messages

By submitting our application, you agree that we may contact you by email and by ordinary telephone call, placed manually by a member of our team, about your request, including document requests and funding offers. Providing a working phone number and agreeing to this contact is required to submit an application, the same way it is required to process a business inquiry with any company.

Separately, our application includes an optional checkbox for automated contact: calls or text messages placed using an automatic telephone dialing system, a prerecorded or artificial voice, or SMS. This consent is optional and is not a condition of applying or of obtaining any financing; declining it does not affect your application or the terms available to you. We maintain an internal do-not-call list and honor opt-out requests promptly. We do not sell or share your telephone number with third parties for their own marketing.

7. Your rights under GLBA

Federal law gives you the right to limit certain sharing of your nonpublic personal information. The sharing with funding partners described in Section 4 is done to process the transaction you requested, which is a permitted disclosure not subject to an opt-out under federal law. We do not share your nonpublic personal information with nonaffiliated third parties for their own marketing purposes.

8. Cookies and tracking

We use cookies and similar technologies necessary for this website to function, and may use analytics tools to understand in aggregate how visitors use the site. These tools do not access your application documents. You can disable non-essential cookies through your browser settings. To opt out of analytics cookies, email info@nordthane.com with the subject line "Cookie Opt-Out."

9. Data security

We maintain a written information security program with administrative, technical, and physical safeguards consistent with the GLBA Safeguards Rule (16 C.F.R. Part 314), including encryption of sensitive information in transit and at rest, access controls, multi-factor authentication on systems holding customer information, periodic risk assessments, and secure disposal procedures.

No method of transmission or storage is completely secure and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you as required by applicable law.

Please do not send bank statements or other sensitive documents through unsecured channels such as standard email or text message. Use the secure upload in our intake process or request a secure transmission link.

10. Data retention

We retain this information for as long as you have an active application or relationship with us, and for up to seven (7) years afterward, to comply with recordkeeping obligations, resolve disputes, and enforce our agreements. Records of telephone and text consent are retained for at least five (5) years after the consent is given or withdrawn. After those periods, information is securely deleted or de-identified unless we are required to retain it longer.

11. Your privacy rights

Depending on where you reside, you may have the right to know what personal information we have collected and how it has been used and disclosed; to request a copy in a portable format; to request deletion, subject to the recordkeeping obligations in Section 10; to correct inaccurate information; to opt out of the sale or sharing of personal information (as noted, we do neither); to limit our use of sensitive personal information; and not to receive discriminatory treatment for exercising these rights.

To exercise any of these rights, email info@nordthane.com or write to the address in Section 14. We will verify your identity before fulfilling requests and respond within the timeframes required by law. You may designate an authorized agent, subject to verification.

12. Third-party websites

Our website may link to funding partner websites, application portals, and other third-party sites. We are not responsible for their privacy practices or content, and this Policy does not apply to them.

13. Changes to this Policy

We may update this Policy from time to time. The "Last updated" date reflects the most recent revision. Material changes will be posted on this page, and continued use of our services after posting constitutes acceptance.
